Comer Warns Biden May Be Subpoenaed to Testify on Cover-Up of His Cognitive Decline

The House Oversight Committee, under Chairman James Comer, R-Ky., is poised to summon Joe Biden, former First Lady Jill Biden, and Hunter Biden to testify about allegations of a concerted effort to conceal Biden’s cognitive decline during his presidency.

Comer announced on Wednesday that he’s open to hauling in the former president himself, following the launch of a GOP probe into Biden’s mental capacity and the use of an autopen to sign documents while he was in office.

In an interview on Fox News’s Hannity, host Sean Hannity questioned the value of bringing Biden in, given his apparent cognitive struggles, as recently evidenced by a leaked October 2023 interview with special counsel Robert Hur.

"I mean, I would have to argue, probably not," Hannity said, doubting whether Biden could provide coherent testimony.

Comer responded, "Well, I mean, again, we’re going to see who was giving the directive to sign these," referring to the autopen’s use.

He added, "If everyone says it was Joe Biden, then I’m certainly open to bringing him in."

Comer highlighted the challenges of compelling former presidents to testify, citing past Democratic efforts to summon Donald Trump after his first term.

"But at any rate, wherever the trail leads is where we’re going to [go]," the Kentucky lawmaker said.

Comer said he would prefer to question Biden directly but noted the probe’s initial focus on staffers who operated the autopen.

"Look, I would love to ask Joe Biden a lot of questions, but right now, we’re starting with the staffers who were operating the autopen. We’re going to bring the physician, Dr. [Kevin] O’Connor, in because he definitely was not telling the truth about Joe Biden’s health."

Comer also revealed that Rep. Ronny Jackson, R-Texas, a former White House physician, will advise the committee on health-related questions, adding, “We’re very fortunate to have a member of Congress that was the previous White House physician, so I think we’re going to be ready to go."

The committee has requested testimony from five former Biden aides, including Dr. Kevin O’Connor, Neera Tanden, Anthony Bernal, Annie Tomasini, and Ashley Williams, as part of its investigation into what Comer calls a "cover-up" of Biden’s cognitive decline.

Comer also indicated that other Biden insiders, such as former White House chief of staff Ron Klain, could face scrutiny.

"I would say Ron Klain’s a very good bet," Comer told Hannity. "But again, we’re going to see where that — where the trail leads."

In the same Hannity interview, Comer suggested that Jill Biden, Hunter Biden, and former White House Press Secretary Karine Jean-Pierre could be subpoenaed if they refuse to testify voluntarily.

"If the trail leads us to the next step, which many believe would be perhaps Jill Biden and Hunter Biden, then we will go there," he said.

Comer noted that the aides, including O’Connor, have "all lawyered up" and are taking the probe seriously, with a deadline to respond by the end of January 15, 2025.

The investigation zeroes in on the autopen scandal, with the Oversight Project reporting a correlation between increased autopen use and Biden’s worsening mental state.

Their analysis found two distinct autopen signatures, with Executive Order signatures showing "increased use of the autopen as President Biden’s mental and physical decline accelerated."

President Donald Trump has warned that the culprits who operated Biden's autopen should face jail time.

In a January 12, 2025, Truth Social post, Trump wrote, "Hopefully ACTBLUE, the Democrats ILLEGAL SCAM used to raise money, including from not allowed ‘foreign contributions,’ is being looked at by authorities. The Dems only know how to win by CHEATING, something which they do better than any group or party in history."

He continued, "Also, why did the Auto Pen give Schiff a Pardon? Biden knew nothing about it. Who operated the Auto Pen? That is the biggest question being asked in D.C. They almost destroyed our Country. They should all be in jail!!!"

Trump also declared last month that all pardons issued in Biden’s final days are void, claiming Biden didn’t personally sign them.

Adding a medical perspective, Rep. Greg Murphy, R-N.C., a practicing urologist and vice chair of the House Republican Doctors Caucus, raised concerns about Biden’s health transparency in a Daily Caller op-ed published Thursday.

"It is paramount that the American people trust that the commander-in-chief and candidate for the highest office in the country receives a comprehensive, complete, and transparent examination," Murphy wrote. "This includes all of the necessary blood work, physical, and diagnostic assessments that would give the nation a reliable understanding of the individual’s physical fitness to lead the world."

He criticized the lack of a prostate screening in Biden’s 2024 physical, noting, "A 2024 memorandum by Dr. Kevin O’Connor, former Physician to the President of the United States, summarizing Biden’s health following his comprehensive physical notably lacked a prostate screening."

Murphy added, "The American people deserve to be confident in the well-being of the President of the United States and the supervision of his medical team. President Biden’s legacy is taking a beating right now, and transparency about this issue could serve to help reverse its decline."

With Trump roaring from the sidelines and the Biden inner circle lawyering up, this probe is a high-stakes showdown.
